Is a spouse’s consent (their OK) needed for me to sell a house? In most cases yes, but not in all cases. An example where their OK is almost always required – is if the house is in both your names, you acquired the the house during your marriage, your spouse is living & you are not divorced. An example where it may not be required, is if the property (say a rental) is owned by a single member LLC, and you are the member/manager of the LLC, and your spouse is not. In that case most title companies wouldn’t care if just you alone signed to sell the house. It really depends on the circumstances, and every circumstance is unique.
